Who we are
Croftura is a product of South Platte Systems LLC, a Colorado limited liability company. By using Croftura you agree to these terms. Our Privacy Policy explains how we handle your information and is part of these terms.
Where Croftura is offered
Croftura is offered from the United States and is directed primarily to users in the United States. We don't target or market Croftura to users in any other country. If you use Croftura from elsewhere, you do so on your own initiative and are responsible for following your local laws.
Your account
You must be 18 or older to create a Croftura account or join a household. Keep your sign-in secure. You're responsible for what happens under your account.
Your data
- You own your records. We only use them to provide Croftura to you and your household.
- We will never sell, rent or trade your data to third parties.
- You can export your records yourself at any time.
- You give us permission to store, copy, back up and display your records as needed to run Croftura for your household. Nothing more. That permission ends when you delete them.
- Croftura is for homestead records. Please don't use it to store sensitive personal information, such as health or medical details about yourself or anyone else.
Our software
Croftura itself, including the software, the name and the design, belongs to South Platte Systems LLC.
Free and paid
Core tracking is free, with no caps on what you track. We plan to offer an optional paid add-on for cost and yield reporting. Using Croftura for your homestead will never require it.
Fair use
Please use Croftura for keeping homestead records. Don't use it to break the law, abuse the service, or interfere with other people's use of it.
Your household
The person who creates a household is the account holder for it. You decide who to invite, and everyone you invite can see and edit that household's records. You can remove members at any time. Removing someone doesn't delete what they already entered. We don't settle disputes between household members. If a household splits up, we'll act on instructions from the account holder. Anyone in a household can export its records.
The service, as is
We work hard to keep Croftura running and your records safe, butCroftura is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.We don't promise the service will be uninterrupted or error-free, or that it won't lose data. Keep your own export if a record matters to you.
Limits on what we owe you
To the fullest extent the law allows, South Platte Systems LLC isn't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost records, or lost livestock, crops, or income. Our total liability for any claim relating to Croftura is capped at the greater of the amounts you paid us in the 12 months before the claim, or US $100.Some states don't allow these limits, so parts of this section may not apply to you.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be excluded or limited under applicable law.
Your side of it
If someone brings a claim against us because of what you put into Croftura or how you used it, you'll cover our reasonable costs of dealing with it.
Ending things
You can stop using Croftura and close your account whenever you like. We can suspend or close an account that breaks these terms, abuses the service or puts other users at risk. If we ever discontinue Croftura, we'll give you at least 60 days' notice and keep export working during that time.
Changes
We may update these terms. If a change affects you significantly, we'll email you or tell you in the app at least 30 days before it takes effect.
Law and disputes
These terms are governed by the laws of the State of Colorado. Any dispute goes to the state or federal courts in Colorado, and we both agree to that. We'll always try to sort things out by email first: write to hello@croftura.com.
EU and UK consumers. Nothing in these terms removes rights you have under the mandatory consumer protection laws of your country of residence. If you're a consumer living in the EU or the UK, you may bring proceedings in the courts where you live, and the mandatory consumer laws of that country apply to you whatever the governing law above says.
